Is an HOA or Condo Pool a Commercial Pool in Florida?
Yes. An HOA, condo or apartment community pool is a public pool under Florida Administrative Code chapter 64E-9, not a residential one.
That chapter covers pools at apartment complexes, condominium and homeowner associations, community centers, hotels, schools and water parks. Only pools serving a single family home or a duplex are treated as private.
So the pool behind your clubhouse sits in the same regulatory bracket as a hotel pool, whether the association has twelve units or three hundred.

What Florida Requires of a Commercial Pool
Every association pool needs:
- A Department of Health operating permit, renewed every year
- Free chlorine held between 1.0 and 10.0 ppm
- pH held between 7.2 and 7.8
- Testing at least once every 24 hours the pool is open
- Every reading written into a monthly pool log, kept on site for one year
The log is where associations come unstuck at inspection. The water is usually fine. The paperwork is missing.
Our board member’s checklist for Florida HOA pool requirements goes through each of these in full, including five questions to ask before you compare bids.
Who Is Legally Allowed to Service a Commercial Pool?
Whoever maintains water quality on a public pool has to hold a Public Pool Service Technician certification under Florida statute 514.075, unless they already hold a public pool operator permit.
In plain terms, the company that looks after the pools on your street cannot lawfully take on the association pool unless whoever handles the water is certified. Ask every bidder for it before you compare prices. It usually explains why one quote is cheaper than the rest.

What Changes for Your Board or Property Manager
Frequency is not a preference. A residential pool can be visited once a week. A commercial pool has to be tested every day it is open, whether by the service company or by someone on site trained to test and record it.
The log is part of the job. An inspector reads records, not just water.
Bather load drives the chemistry. A community pool on a holiday weekend carries a load a family pool never sees. Equipment works harder and fails sooner, which is why pump, filter and heater repair matters more on a commercial pool.
Serving Association Pools Across Brevard County
We service homeowner association, condominium and community association pools in Melbourne, Palm Bay, Viera, Suntree, Rockledge, Satellite Beach, Palm Shores and West Melbourne.
Cleaning, water chemistry and equipment work are the same trade on a community pool as on a residential one. What changes is the cadence, the record keeping and the certification behind it. See the full range of pool services we run.

Frequently Asked Questions
Does a condo pool count as a public pool in Florida?
Yes. Condominium, apartment and homeowner association pools all fall under Florida Administrative Code chapter 64E-9. Only pools serving a single family home or a duplex are treated as private.
How often does a commercial pool have to be tested?
At least once every 24 hours on every day the pool is open, with the result recorded in the pool log.
What chlorine level does Florida require in a public pool?
Free chlorine between 1.0 and 10.0 parts per million, or the equivalent bromine level, with pH between 7.2 and 7.8.
How long do we have to keep pool records?
The monthly pool log is kept at the pool and retained for one year.
Can our regular residential pool company service the HOA pool?
Only if whoever maintains the water quality holds a Public Pool Service Technician certification, or is otherwise exempt under Florida statute 514.075.
Does the association still need its own permit?
Yes. The operating permit belongs to the facility and is renewed annually with the Department of Health. A service company does not replace it.
